All proprietary content hosted on H1BIndex.com, including but not limited to the source code, visual design elements, Bento grid interfaces, SVG iconography, typography choices, and written methodology, is the exclusive intellectual property of H1BIndex and is protected by United States and international copyright laws.
Furthermore, our programmatic grading algorithms, including the "H1BIndex Grade," "Commitment Score," and "Layoff Risk Index," are strictly proprietary statistical models owned entirely by H1BIndex. Unauthorized reproduction, reverse engineering, or commercial resale of these specific metrics is strictly prohibited.
2. Compilation & Database Copyright
H1BIndex explicitly acknowledges that the foundational Labor Condition Application (LCA) numbers and prevailing wage data are sourced from public domain records provided by the Department of Labor (DOL) and USCIS. We do not claim copyright over raw government facts.
However, the selection, coordination, arrangement, and systematic enhancement of this data into a relational, searchable database constitutes a protected "Compilation" under 17 U.S.C. § 101 of the U.S. Copyright Act.
You may not programmatically scrape, mass-download, or clone the H1BIndex database structure to create a competing product. Doing so infringes upon our compilation copyright and will result in immediate legal action.
3. Fair Use & Proper Citation
We encourage journalists, researchers, and professionals to utilize our platform to understand the immigration labor market. You are permitted to reference our data points, screenshots of our UI, or our algorithmic grades in external publications, articles, or social media, provided that such use falls under "Fair Use."
If you quote or utilize proprietary metrics from our platform, you must provide clear, visible attribution to H1BIndex and include a direct, do-follow backlink to the specific page on our Platform where the data was sourced.
4. DMCA & Infringement Notification
H1BIndex respects the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Platform, please notify us immediately in accordance with the Digital Millennium Copyright Act (DMCA).
Your notification must include:
