1. Acceptance of Terms
By accessing, browsing, or registering for an account on H1BIndex.com (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately discontinue your use of the Platform.
We reserve the right to update, modify, or replace any part of these Terms of Service at our sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of the Platform following the posting of any changes constitutes binding acceptance of those changes.
2. User Accounts & Data Vault
Certain features of H1BIndex, including the personalized Dashboard and Data Vault, require you to register for an account. By registering, you agree to provide accurate, current, and complete information, and to maintain the security of your password and identification.
You are fully responsible for all activities that occur under your account. H1BIndex employs advanced cryptographic hashing and rate-limiting to protect your data, but we cannot be held liable for unauthorized access resulting from user negligence or credential sharing. We reserve the right to suspend or terminate your account if any information provided during the registration process is found to be inaccurate, deceptive, or utilizing prohibited temporary email domains.
3. Prohibited Conduct & Anti-Scraping Mandate
H1BIndex is a data platform built for human professionals. To ensure server stability and protect our proprietary infrastructure, the following actions are strictly and legally prohibited:
- Automated Extraction: Utilizing any automated system, software, bot, spider, or scraper to extract data, text, or database structures from the Platform for commercial or non-commercial use.
- Denial of Service: Bypassing our Web Application Firewall (WAF) or engaging in activities that impose an unreasonable or disproportionately large load on our server infrastructure.
- Reverse Engineering: Attempting to decompile, reverse engineer, or independently discover the source code or underlying algorithms behind the "H1BIndex Grades" or Market Value calculations.
Violation of our Anti-Scraping Mandate will result in immediate, permanent IP blacklisting and potential legal action to recover damages for server exploitation and intellectual property theft.
4. Intellectual Property Rights
H1BIndex acknowledges that the raw Labor Condition Application (LCA) data and prevailing wage records are public domain information provided by the U.S. Department of Labor. We do not claim ownership over raw government records.
However, the specific compilation, structuring, visual presentation (Bento grids, custom UI), algorithms, codebases, and proprietary grading systems (e.g., "H1BIndex Grade") are the exclusive intellectual property of H1BIndex. You may not reproduce, distribute, or create derivative works from our proprietary layouts or algorithmic insights without express written permission.
5. Termination & Access Restriction
We reserve the absolute right, without notice and in our sole discretion, to terminate your license to use the Platform, and to block or prevent your future access to and use of the Platform if you violate any of these Terms of Service. Upon termination, all provisions of these Terms which by their nature should survive termination shall remain in full force and effect.
